Indie Film Marketing

Privacy Policy

Last updated: 1 October 2026

This policy explains how Indie Film Marketing collects, uses, shares and protects personal information. It covers our website, our enquiry and questionnaire forms, our newsletter, our calls, and the work we do for clients.

  • We collect only what we need to understand your film, reply to you and work with you.

  • We never sell your personal information.

  • We send you marketing emails only if you've opted in, and you can unsubscribe at any time.

  • We use trusted service providers to run our business, and some of them store information outside Australia, mainly in the United States.

  • You can ask to see, correct or delete your information at any time.

THE SHORT VERSION

1 - Who we are

"Indie Film Marketing", "IFM", "we", "us" and "our" refer to Indie Film Marketing (AUS) and Indie Film Marketing (US), which together operate indiefilmmarketing.com. We are responsible for the personal information described in this policy.

2 - What we collect

WHEN

  • You submit our enquiry or pre-call forms

  • You book a call

  • You subscribe to our newsletter

  • You become a client

  • You visit our website

  • You email or message us

  • Name, email, phone (optional), company, role, where you're based, and details about your film: title, budget range, stage, release timing, distribution, audience, financing, marketing budget and the help you need

WHAT WE COLLECT

  • Name, email, the time you chose and your time zone. Calls are held on Zoom

  • Billing details, contracts, approvals and project materials you share with us. Card payments are processed by our payment provider, and we never see or store your full card number

  • First name, email, and a record of your consent

  • Technical information such as your browser, device and pages viewed, collected through cookies (see section 5)

Please don't send us sensitive information, such as health information, that isn't needed for our work. If you share information about other people, such as cast, crew or co-producers, please make sure you're allowed to.

You don't have to give us your information, but without it we may not be able to reply to your inquiry or work with you. You can contact us without giving your name, but we'll need an email address to reply.

  • Whatever you choose to include

3 - Why we use it

We use your information to:

  • reply to your enquiry and work out whether our services fit your project

  • schedule and hold calls, and send confirmations and reminders

  • prepare proposals, contracts and invoices, and deliver the services you engage us for

  • send our newsletter, if you've opted in

  • keep records we're required to keep, for example for tax and accounting

  • run, secure and improve our website and business

  • protect our legal rights and deal with disputes

Where EU or UK law applies, we rely on these legal bases: taking steps toward or performing a contract with you; your consent (for the newsletter and non-essential cookies); our legitimate interest in running and growing our business; and our legal obligations.

Automated sorting of enquiries. When you submit our enquiry form, our system sorts it automatically using your answers about film budget, marketing budget and role. It then sends you the matching next step, such as an invitation to book a call or a note that we may not be the right fit. Enquiries that sit in between are reviewed by a person. If you think your enquiry was sorted incorrectly, reply to any of our emails and we'll review it personally.

4 - Who we share it with

We don't sell, rent or trade your personal information. We share it only with:

  • Service providers who help us run our business, under terms that require them to protect it

  • Professional advisers, such as our accountant and lawyer, when needed

  • Partners on your project, such as a PR or distribution company, but only when you ask us to or agree

  • Authorities, when the law requires it

  • A buyer or successor, if our business is sold or restructured, under the same protections

Overseas disclosure. Many of these providers store information outside Australia, mainly in the United States. Before using a provider, we take reasonable steps to make sure it protects personal information to a standard similar to Australian law. Where EU or UK law applies, we rely on recognised transfer safeguards, such as standard contractual clauses or a provider's certification under the EU–US Data Privacy Framework.

5 - Marketing emails and cookies

Newsletter. We add you to our newsletter only if you tick the consent box on one of our forms. Every newsletter has an unsubscribe link, and unsubscribing takes effect promptly. Separately, we'll still send you emails about an enquiry you've made or work we're doing for you, such as booking confirmations and invoices.

Cookies. Our website uses cookies and similar technologies to work properly, remember your preferences and understand how visitors use the site. Where the law requires it, we ask for your consent before setting cookies that aren't essential. You can block or delete cookies in your browser settings, but some parts of the site may not work as well.

If we start using advertising tools such as the Meta Pixel or Google Analytics, we'll update this section to say so, and ask for consent where required.

6 - Storage, security and retention

We store personal information electronically with the service providers listed in section 4. We protect it with reasonable steps, including:

  • access limited to the people who need it

  • strong passwords and two-factor authentication on our business accounts

  • reputable providers that use encryption and other security measures

No system is completely secure, so we can't guarantee that information will never be accessed without permission. If a data breach is likely to cause you serious harm, we'll notify you, and the relevant regulator where required, as soon as practicable.

How long we keep it.

  • Enquiries that don't become projects: up to 2 years after our last contact, so we can pick up the conversation if your plans change. Then we delete or de-identify it.

  • Client records: for as long as we work together, then 7 years to meet tax and record-keeping obligations.

  • Newsletter subscribers: until you unsubscribe. We then keep only a record of the unsubscribe, so we don't email you again.

Everyone can ask us to:

  • show you the personal information we hold about you

  • correct anything that's wrong or out of date

  • delete your information, unless we need to keep it for legal or record-keeping reasons

  • stop sending you marketing emails

If you're in the EU or UK, you also have the right to restrict or object to how we use your information, to receive a copy in a portable format, and to withdraw consent at any time.

If you're in the United States, you may have additional rights under your state's privacy laws. Contact us and we'll respond in line with the law that applies to you.

To make a request, email info@indiefilmmarketing.com. We may need to confirm your identity first. We'll respond within 30 days, and we won't charge you unless a request is clearly excessive. If we can't do what you've asked, we'll explain why.

Complaints. If you think we've mishandled your information, please email us first. We'll acknowledge your complaint within 7 days and aim to resolve it within 30 days. If you're not satisfied, you can contact:

  • Australia: the Office of the Australian Information Commissioner (OAIC), oaic.gov.au

  • EU: the data protection authority in your country

  • UK: the Information Commissioner's Office (ICO), ico.org.uk
